IPhone annual upgrade

I just have a curious question about the early upgrade.  Considering all authority of "good and working condition" is in Verizon's hands, if they deem a phone not eligible and charge me the remaining balance, will I at least get the phone back?  I think the phone is fine, but who knows if someone examining it is just having a bad day and flags it for something I am unaware of.  In theory if I am charged the remaining balance, technically I own the phone.  Doesn't seem right they can charge the balance and also keep the phone.  For reference I have an XR I want to upgrade to the 11.

I am a consumer too and I sincerely understand your concerns about the condition of your phone if you do an early upgrade (https://www.verizonwireless.com/support/annual-upgrade-program-for-iphone-faqs/), woodlog22. Please be assured that our warehouse team will do a careful inspection of the phone that you return and if you phone does not have any physical damage aside from normal wear and tear, no water damage (https://www.verizonwireless.com/support/knowledge-base-141830/), and the phone works correctly, you will not have any problems with the balance of the device being paid off.

Do you see anything that could be considered physical damage on your phone?

There is the smallest little smudge on the far left, not even technically the screen that I can't buff out.  You can only see it in certain light.  I would consider it normal wear and tear.  My questions isn't whether the phone will pass, but rather if it fails will it be returned to me or will I be charged and have the phone stolen away as well.
