Can I get a free replacement device?

So recently my girlfriend's dad gave me an asurion verizon wireless replacement iPhone 5. He was going to give it to their other daughter but she moved out and I needed a new phone. I took the phone to the verizon store and got it activated with my account and all, but the phone is now having battery problems, it doesn't hold charge almost at all, I am constantly having to charge it. When I look at my usage, i have like 1.5 hours of actual use and not standby, and by this time it's at like 11%. I know iPhones battery aren't the best, but this seems a bit much for me. I did a device check through my verizon and it says everything that could be contributing to problems is fine, so it is definitely a hardware problem. My question is, can I take it to a store and get another asurion replacement for free because this one is messed up straight out of the box, or is that not possible because I didn't order it through my account? I have the box and sim card and everything that came with it. I've had it for like a week and it's consistently draining to fast, i tried restarting, letting it die and charging, etc etc with no luck. I haven't dropped it, or touched it to water, it's in an otter box commuter case with a glass screen protector.

If the phone is from Asurion, it is an insurance replacement device. Meaning that it was replaced under damages covered by the insurance. The device is most likely a refurbished phone,since Asurion doesn't replace devices with new ones. Normally in a refurbished replacement, the battery is generally not replaced. Since the phone was replaced under another account holders insurance, and was given to you, and you activated on your account, the previous insurance is no longer valid. Verizon will not replace it since it was an insurance claim replacement. Also, the warranty is more than likely expired.

I called verizon, who then gave me the direct number to asurion, I called them, and they said to have my father in law call them and they would send a new replacement, because the phone is only like a month old if that. They said their warranty is 1 year. I knew it was a refurbished device, but when you pay good money monthly for good insurance and then spend good money on a deductible, you expect essential functions to work like they should for how long they're expected too.

I'm glad it worked out for you. I just went through the insurance scenario. Mine didn't turn out as did your results. And I do agree with you on the cost of the insurance and deductible, you would expect a little bit better results on the replacement device.
