All of this bantering back and forth about whether a lawsuit would be frivolous or not really isn't resolving anything. If those who are talking lawsuit really are serious, they will go out and try to find a lawyer to take the case. Either a lawyer will take the case or not and finding one that will take it on contingency may be even harder to do as they won't take a case unless they are reasonably sure they will win. If you can't find a lawyer to take it on contingency, you may as well give up as your lawyer fees could exceed 10's to 100's times the cost of a new phone.
In other words, if you are upset enough to sue, then try to do so, otherwise you are tilting at windmills by continuing the arguing and complaining here.

There aint nobody suing anyone Samsung or Verizon you have no ground to stand on. This nonsense has to stop people and forget about Froyo or gingerbread they are not giving you anything like that for the fascinate got it? Thank you for your time

Again I saw it with my own eyes posted to Samsung's Question and Answer product web page with information about the Fascinate in Late November 2010 when I purchased my phone. That is what is called published. They did publish the update was coming by year end 2010. Now how to retreive a copy of that is another question. I've tried archive org but it only goes back to Oct 8th. Any other ideas to retreive web site history?
There is not a conspiracy in that nearly all who asked the Verizon sales reps were told an update was coming by year end 2010. Because it was the official stance.
