I wish the U.S would get on the ball and institute loser pays.  If they would simply add this policy to our court system, there would be MILLIONS in tax payer dollars saved each year.

Yes!!! I would join.   I am actually a former Tech with Verizon and chose the fascinate based on what the head of product development told me.   He Lied.   But while we're at it. . . .how about a class action suit against them for the differences in Plans.    3 States including Texas get unlimited to ANY Mobile with their plans while the other states are stuck with Nationwide family share plans.     Check it out . .. it's called Mobile to any Mobile which includes the same minute allowance to landlines and is the SAME price as the Nationwide Talk and Text.

It's called test markets.  Not like they're trying to give everyone else the shaft.

Regional offers are a totally legal and legitimate business practice.  Can I sue McDonald's because a Big Mac in California costs more than one in Kentucky?  Pretty sure they are using the same ingredients. As far as the class action for FROYO, it is a total non-starter.  Verizon never quoted an availability date for it.  Whatever the head of product development told you is irrelevant, because he was probably basing his statement on current information at the time.  Perhaps when Samsung took FROYO into testing that found some significant bugs that needed fixed and so the update was pushed back.  The bottom line is that Verizon never published either on their web-site, in their print materials, or on their automated systems a release date for FROYO on the Fascinate.  You bought a phone with 2.1 you have a phone that runs 2.1 simple enough.

Those phones weren't guaranteed FROYO either.  Granted they got it, but there are still plenty of Android based phones on Verizon that didn't get upgraded to FROYO.  Heck the Motorola Devour still runs DONUT (1.6) last I checked.

you're correct. the reason it doesn't get anything beyond donut is, it struggles to even run that. it's basically a multimedia phone with android and motoblur. as a matter of fact, most of the advertisements I saw didn't even mention android, and instead only mentioned motoblur.

Okay.   {please keep your posts courteous}   Why would a feature that allows FREE Mobile to ANY Mobile need a test market?   {please keep your posts courteous}  That's the lame excuse Verizon uses, it is only available in those markets because Verizon is #4 in those states behind AT&T, Sprint and yes EVEN T-mobile!!!!  You don't have to test market a cheaper plan, it's called corporate greed!

As far as FROYO.  You maybe weren't promised FROYO, but I WAS!!!!   I was at the sales meetings, regional meetings that announced that FROYO would be on our phones quickly.   6 months is not QUICKLY!  I hear sales reps every day say that FROYO will be released on the Fascinate within the week or within 2 weeks.    Guess what?  The worry free guarantee is only 14 days now, so you wouldn't be able to return the phone if the update doesn't come soon enough.

The facts:    1) Verizon cares about only the new products on the market . . . . the iphone the xoom, no thought is ever given once you leave the door.   2)  The update has been available for people for a few months if you have your phone rooted (which voids your warranty)  3) Verizon Employees repeat the constant lies of there management to produce sales, no real regard is given to your personal needs or usage of a phone.   4) They are no different than any other mobile carrier out there, too bad ETHICS is not part of normal society.

you clearly don't know how business markets work.

mcdonalds not only prices things differently in different markets (sometimes drastically differently), but it has sweet tea some places, not others, certain sandwiches are regional, and menu offerings can be quite different from place to place in general. it's the same with verizon. and it's their legal right as a business.
