So I posted this thread a couple of hours ago and then left it alone to see the general concesus. To my surprise, there is quite a high level of people against the idea. Some of you are a bit off base with your analogous comparisons, some are complacent, some of you are clearly Verizon employees who are quick to defend your company, and only a couple who were upset at the current situation.

 

In the end, everyone is entitled to their opinion and their own level of tolerance. Personally, I don't take being lied to very well. If you do....that's your perogative. Also, I don't like that I've paid the same amount of money as a Motorola or HTC customer but have less browser access. Again, if you're OK with paying the same amount for less access, that's your perogative.

 

I don't have any delusions of grandeur  by thinking that if I left Verizon that they would actually miss my business nor think that a lawsuit of this nature would bring Verizon to it's knees. That's not even my aim. My aim is simply to get fair treatment for those who were given a certain level of expectation by the sales force, but never receiving it. Had I been told that the update would be stalled for the Fascinate by 4 to 5 months, I most certainly would have went with one of the other two phones.

 

If the update for the fascinate was a month later than what Motorola and HTC got...fine. That's acceptable. 2 Months...you're pushing it. But 4-5 months? That's just rude and flat out bad business practice. I think a fair compensation would be that all Fascinate users receive a small credit as a form of recognition that we had to put up with a lack of support and limited browser access compared to Motorola and HTC users. I don't think I'm unreasonable in expecting not to by lied to.

 

I've been with Verizon for many years now. They used to have absolutlely horrible customer service, but have improved considerably in that area in the past couple of years. It would be nice to see them step up an be accountable for this, but I doubt they posess that level of prudence.

If you're really looking to flash as being that big of a deal, you're going to be highly disappointed when the update is finally pushed out.  I had it on my OG Droid and have had it with Froyo on the Fascinate for nearly a month. I bet I can count the number of times I've used it on 1 hand.  It's convenient to have but definitely not the greatest thing since sliced bread.

No, you can't simply go to the market and download the app. If it were that easy, this thread wouldn't even exist.

 

 And the practice of promising a certain level of service in the business world is quite common. You expect a certain level of service when you go out to eat because the commercial you saw promised it. If the food is horrible or the service is terrible, you most likely would ask to speak to the manager and hope that they would do what they can to right the situation. If you have a landscaper come to your home and give you a bid on work to be done, would you pay them if they didn't deliver on what was promised? What about getting your car washed? Would you pay if your keys were handed back to you and the car was still dirty?

 

Being promised a certain level of service and not getting it happens all the time. The only problem here is that Verizon AND Samsung keep kicking the can down the road by continuously promising "any day now" and probably feel pretty comfortable now stalling on their customers and thinking that we wouldn't do anything. My next phone most likely will be with Verizon. I mean, c'mon. Their coverage is awesome. But I will never buy from Samsung again.

@ PJN and Soulchaser....Yeah, I saw that a leaked version got out a month ago, but was weary about rooting my phone. Once I started the process, my phone started acting a little quirky so I discontinued the process and figured I'd just wait for the "Official" release. I read the forums on other sites all the time, and some of the contributers speak  as if they assume everyone is as tech saavy as they are. I was kind of hoping for a more dumbed down explanation on how to get the leaked version on my phone.

 

Plus, with leaked versions of any software, you run the risk of getting a version that still has some bugs in it.

Same can be said for the official updates.  DL30 (leaked Feb 5th) was a little buggy but EB01 (leaked Feb 10th) has been pretty much flawless for me.  It does seem to use a little more battery while idle and some have reported that the integrated corporate email is buggy (I use Touchdown) but I have no intentions of going back to stock to receive the official OTA when available. And if you get the itch again, I'd suggest androidcentral.com.

I was trying to find some infomation about the update and stumbled across this...Both sides amaze me to and

extent.  First, to the pro lawsuit crowd, It's a longshot, an update shoots it in the foot if released, and I bit over the

top in my opinion.  But the anti lawsuit crowd really is what amazes me, and a good part of what's wrong with

our country, and why people feel the need to sue.

 

First off, my sales person never said I would get froyo, 2.2 or whatever.  However, he, and another I spoke to earlier,

promised native flash support in a comming update (right around the time of apple's spat with adobe), as a sales

point that the whole building seemed to know. I think  a lot of people are in this boat.

 

The part that amazes me is that when this is stated, so so many people point to some obscure reference in

one of the documents that says "you are entilted to nothing once you by, and not one promise or sales point

are we under obligation to honor".   While this may or not be legally correct, is this the kind of conduct

that VZW, other posters, and so many seem to advocate?   Are "legal" and "ethical" interchangeable?

Are ethics and truthful sales pitches "quaint notions of a bygone era"?

 

I, for one, expect honest dealings, and am not yet ready to join the "you signed a paper" with the understanding

we have no obligations past taking your money crowd of business ethics.

 

The lawsuit is a longshot, and VZW will probably make good....I understand.

You bought it and no matter what anyone told you, you'll get nothing and like it.........sad.

Yep, exactly right, but the option exists for a limited time.  I believe it is one hour.
