No lawsuit can be filed. Verizon gave proper notice to the customers and news outlets.

You had a choice, you could have bought your phone at full price and kept unlimited.

You opted for a subsidize phone for $99-$199 + $30 upgrade fee.

if still under 14 days take it back pay a restocking fee of $35 use your old phone and keep your unlimited.

What would the lawsuit even be about?  They haven't taken unlimited data from anyone.  They just aren't letting anybody sign a new contract with it.  While I don't agree with it, it is totally within their rights to do it.  If you want unlimited data and you don't have it already (and are willing to pay full price to get a new device or get one from eBay, Craig's List, etc.) then you will have to go with a different carrier.

I contacted Verizon before getting a new phone. They told me what would happen with my unlimited data. So I chose NOT to upgrade from my HTC Droid Incredible 2. I decided to take my money elsewhere, bought a Nexus 4 and I'm taking my 2 lines to T-Mobile. And saving $700 over 2 years in the process.

This absolutely sucks. I have 5 phones on what used to be a family unlimited data package. When I last updated the primary phone on this account I was told that if I didn't change my plan that the unlimited data would continue. My daughters phone crapped out and she went in and bought a new phone. Now, she has a 2 Gig cap that also extended the contract two years. I am told the contract was extended because she "upgraded" the plan and got a discounted ($99 phone). Nobody explained to her that getting the "discounted phone" that used to be free would extend my obligation two years. How do they possibly consider going from an unlimited plan to a metered plan an upgrade? Verizon can take me to court. I am ending my contract soon.

It is clearly explained when you don't pay full price for the device. You have no case.

However if it has been less than 14 days you can bring the phone back, pay a restocking fee and then unlimited is back.

If you are wanting your daughter to have another device you will have to pay full price.

Also you were charged a $30 upgrade fee for the reduced price phone. So I would go back and get the phone either on the 12 month payment plan or just pay full price.

Good Luck

The phone is an upgrade.  That has no bearing on the plan.

I think your approach is the most logical one not to let Verizon assume customers do not have a choice. Sure they have the right to do whatever they want, sure Verizon' CEO can go in front of crowd and brag about taking the unlimited plan away from its customers just because they can. I have been a loyal Verizon customers for almost 10 years. Now the time has come to move to a corporation that while taking care of its bottom line at least pretends to care about its paying customers. The "option" of paying full price for an upgrade is nothing more than making you pay for the plan at a different stage in the transaction. About a year ago, I was told my unlimited data plan had been grand fathered. Verizon just did not clarify it had grand fathered its customers until they try to upgrade their devices, that is not the definition of grandfathering. I upgrade my phone every 2 years, now I can't because I will lose my unlimited data plan before I make my move to a new carrier. I encourage all Verizon customers that have been wrong by this company to move to another carrier, do not give any of your business to Verizon. It is the only option you have as a paying customer. Do not even consider paying for this plan in the form of full price for un upgrade. Motorola (Google) should offer the same phones through other carriers. Otherwise they will end up losing us to other phone manufacturers as well.

I won't upgrade because of this change to unlimited.

This change happened a long time ago and the topic has been beat to death. I'm surprised some customers still don't know about it.
