Verizon Buy One Get One Free on the Droid Eris is False Advertisement

Please explain why this advertisement is not considered false advertisement. 
Please allow me to explain.  My wife purchased a Droid Eris as a Christmas present for me, and she wants one but we were told the other line on the account is not eligible for upgrade.  But when you read the advertisement either in store or online it states Buy one get one free with 2 year activation per phone.  I asked both in store and called the customer service rep for online to show me in writing where it states the line has to be eligible, and no one can produce it to date.    In store it says see rep for details.  I asked to see the policy that states I can not use this offer and he says because I said so, and I can not show you anything in writing. So some please explain how Buy one get one free with 2 year activation per phone is not considered false advertisement.  I need to see an official document generated by Verizon Wireless that clearly states the other line has to be eligible for upgrade.  Dated before today.

i believe its for a "new two year activation" and technically your other line isn't "new", it's "used". but i remember somewhere in these forums that the second line in never eligible for upgrade, only the main line. check out these threads to help you:

i think in order to take advantage of the BOGO offer, you need to canel the second line and get a new secondary phone number.

Here where the problem may be for Verizon.  At the time of purchase my cousin was with my wife, and she brought up the point that we did not get a free phone. Well she is an attorney with the US Department of Justice.  May not mean anything but if I push the issue she will represent me.

Was the line that was eligible for an upgrade the primary line?

Because if it was then the other line should have been able to ugrade as well.

My whole family got droids a month ago, but my dad wasnt able to upgrade, but our rep told us that if the primary line can, than everyone else will be able to too.

Yes, it was the primary line that was eligible.  Look I am not trying to be difficult.  All I am asking is if the policy states that the line has to be eligible then show it to me in writing and I go away, and admit that I was wrong.  But if you can not produce the [policy in writing then honor your advertisement.  Period ..

Based on the ad here it has to be a NEW 2 year activation per phone. Since neither your primary or secondary lines are NEW 2 year activations, you're not eligible.

 

So there it is in writing.

When click on the phone and read the ad this is what it says:

 

Buy the DROID ERIS by HTC and Get One FREE!
with 2yr activation per phone

This is a cut and paste from the VZW page for the HTC Eris.  There is nothing else that says with New or eligible line.  More times then not they will put details in fine print, or a link to click on.  There is nothing else.  I called the CSR and asked to point me to a web page for the details around the buy one get one free, and she could not find it, only verbally she said, “you can not do it.”  I then went into the store and talked with the Assistant Manager and the card above the phone in the store says, “see rep for details.”  I asked to see in writing that it states the line must be eligible, or even new, and his response was,  “I can not show it to you, but I know I can't.”  Look I am asking for something very simple if the policy state the line must be eligible or even new show it to me in writing (period)..  Otherwise honor your advertisement.  So again if you can find it in writing please tell me and this becomes a moot point.

The link I provided IS the detailed page for the "Double Your DROID!" offer. The ad clearly states "with new 2yr activation on voice plan with email feature req'd per smartphone."

 

Again, it's right there, in writing. For your benefit, here is the image itself:

Not sure what the confusion is about but it's clear as a bell to me.

The ad plainly states "New 2yr activation on voice plan with email feature req'd per smart phone". Unfortunately for you, Verizon doesn't consider your "upgrade" as a "new activation". That one sentence is what you're looking for "in writing". What I understood the promotion to offer is if you bought one Droid, you get a second one free but you have to sign up for a completely new telephone number. Just wait for upgrade eligibility and buy one then at the discounted rate.
