Is he really misinformed or do you have a dilusional sense of the law?  Did you sign a contract with Verizon stating that they would be upgrading the Eris to 2.X?  No.  You purchased a phone that has 1.5 with the "promise" from some low-level employee (and yes, even store managers are low-level compared to upper management) that they would be updating to 2.X in the near future.  I've got news for you, promises don't hold up in court.  Do you really think that the peon salesman you spoke to actually had real insider knowledge of when Android 2.X would be release?  Come on, use your head.

 

Besides, (and this is where the dilusional part comes in) do you really think a judge is going to allow a class action lawsuit just because you were "promised" a minor upgrade to your phone?

 

Just so you don't go off thinking that I don't care either, I also have an Eris and I also was "promised" 2.X in the near future.  I am a tech geek also.  I worked at Best Buy for 4 years and at the time had all the latest and greatest stuff, but you don't hear me making empty threats about class action lawsuits for something as trivial as this.

 

Bottom line -   Your phone works!  Get over it!


If a representative of the company says you will be getting X, you might have a case. If hundreds of representatives say you will be getting X, you probably do have a case. I'm a low level employee where I work, but if I said a customer would get something, they'd either get it or I'd be on the street.

 

That is all irrelevant anyway, since I never once mentioned a class-action lawsuit, nor do I have any intention of ever attempting such a thing. I'm not sure where you got this. Come on, use your head.

 

I still find it hilarious that people are willing to site back and take it without putting up any fight at all. Sounds like fun.

 

Edit: Whoops! Wrong OP. Yeah, class action isn't going to happen. I'll sign up if wec starts it, but you won't see me sticking my neck out there. I still think people shouldn't be so quick to just suck it up and take it.

Hey! I bought my laptop, with Windows Vista pre-loaded, 2 years ago and now Windows 7 is out. I better get my free copy of Windows 7 in the mail soon. I was promised free updates with my computer through Windows Update, but they're not giving me Windows 7. I wan the new OS and I want it now!

 

I should've known buying the cheaper laptop with an older Operating System wasn't the way to go, but the sales guy at Best Buy said Windows 7 was coming out so I bought the cheaper laptop expecting an upgrade as soon as it was on the market. I was told my computer was just as good and now I'm left in the dust with an old operaing system.

 

I want Best Buy to give me the better computer for free and they better not say no. They owe this to me, they told me Windows 7 was coming out and it was possible for me to upgrade to it.

 

Sound familiar?

no honestly it DOESNT sound familiar....

 

I was trying to decide between a great phone, the MOTO Droid, the draw back was it was to bulky for my liking and the keyboard was poor in design. my other option was the ERIS but it was missing a KEY component turn by turn directions...

 

so i discussed this with the sales person and the manager, both agreed and directed me to the the ERIS because, and i quote "this eris has been approved for the 2.0 upgrade and will be receiving it in the first 3 weeks of January, you will then have the turn by turn directions"

 

now that came from a sales person (somewhat unreliable) and a store manager (i would hope that is slightly more reliable)

 

so i asked "your sure this (the eris) is getting the upgrade the first 3 weeks on Jan?"

 

reply "yes absolutely"

 

Now im not asking for the incredible, sure that would be nice, but i dont feel i am owed that...i dont feel i am owed anything more than what i was told and reassured would happen with the device i had purchased...that being an upgrade that included turn by turn directions for google maps.

 

it isnt a matter of give me give me give...it is a matter of do what you said you were going to do...on the timeline you said, now things happen timeline get pushed back, but we are now talking a 3 month delay. keep us updated, let us know what is happening, dont treat us like mushrooms (in the dark and constantly feed &*^%).

 

I know im not the only person who was given false promises...what it amounts to is false advertising by the store staff, right or wrong they shouldn't have said anything...if the store had not said anything and made promises they couldnt confirm and fulfill then we would have no problem. Eris users would just have an older phone that didnt have the ability of the newer phone, but the fact remains promises were made and not met so that is why people are upset.

 

as for all your previous comments about not buying products that dont have certain features and are waiting for an upgrade. The industry i work in that happens ALL THE TIME...and if my company makes a promise it cant fulfill we have consequences, product is returned for full refund and without penalty....why should it be any different here?

If they do not update the Eris, pretty soon you won't be able to install any of the new apps that come along. It is for this reason that yes, Verizon Wireless does need to give us the update. I am not going to stand by while a phone I purchased only 4 months ago turns into a relic before it is a year old.


 

How many times have you had a computer program come out that is not compatible with your OS?  It happens all the time.  When that happens, do you go to Microsoft or Apple and complain?  Why would you, they didn't write the program.

Ok, now I might agree that ethically they should release the update, but I think the more ethical thing they should do is advise their salesmen (and women) to stop spreading unsubstantiated rumors.  If the customer service reps don't know, and there has been no offical word from Verizon, then the salesmen should not be promising something they have no control over and that is what Verizon needs to and should put an end to.

 

I understand that you, and I, and others like us feel like we have been lied to and generally treated like we are 2nd or 3rd tier, but if we had never been told that rumor, many of us still would have bought the Eris and never thought twice about it.  It is a great phone (best one I've ever owned) and I am going to enjoy it just as it is and I would advise you to consider doing the same.

The only reason I know how it works is because I was in your shoes once before. My very first phone was an HTC G1. The day of it's release I had it and have been on Android since. The update got as far as 1.6, and in case you weren't aware, from RC29, that's four updates in -- alot for what the G1 had at the time. Now, why a rep was trying to sell you an Eris over a Droid, I don't know. The Droid is far superior.

 

Maybe it was ignorant of me to think that rep had the slightest clue what he was talking about, but the fact of the matter is that he and hundreds more sales reps across the country sold the Eris on this very premise. The software would have to be an absolute wreck to take this long to correct, and good consumers need to let companies know when they feel ripped off.

 

"Good" consumers feel ripped off when they get billed correctly (and yes, I mean correctly -- data overages anyone?), "Good" consumers feel ripped off when new policies are made, "Good" consumers feel ripped off when they have to pay something they don't want to. Just because you had a retail rep who works off comission and isn't nearly as knowlegable about the product as the rest of us here tell you something wrong it doesn't mean you'll get something out of it. 2.1 will come out for the Eris, Yes. When, we don't know. Would you rather have a crappy 2.1 filled with bugs and glitches, or would you rather have a 2.1 that works beautifully. The difference is having the update NOW, and having the update later.

 

I fully expect a better device to come out the day after I buy whatever I buy, but I was made to feel that I had bought a 2.1 phone, it was just a matter of weeks. That isn't what I got. I'm not quitting until I fill at least one important person's voicemail.

 

You have 30 days to test and try this phone before you can keep it. You're trying to tell me in 30 days you didn't do not one ounce of research?

When the Droid came out they gave some people a free pass, so it's not unheard of. People are just tired of waiting when there is obviously a build out there, see all the numerous rooting or flashing to 2.1 posts. It's a matter of industry standards, every computing device or software gets regular updates to optimize performance and enhance users experience, it is a smartphone, not a pager.
