When you announce it publicly it is the same as saying you promise. Neither a promise or a public announcment of this sort would hold weight in court, but I'm not a lawyer if one would like to weigh in here.

Public announces=/= promises, because just because you're advertising a product to be, it doesn't mean it's going to be delivered. Take a look at the Droid update and see what happened there.

 

Just because you get people hyped up, if you can't deliever the product for one reason for the next then you can't. And Verizon will have to take the hit for that if they don't deliver it. But no legal action could/would take action as no contracts were signed in light of it.

He wasn't advertising a product. He said these phones will get the 2.1 android update. Plain and simple, he didn't say when or anything. HTC is saying around June Hero should be getting it, but still not a specfici date which is fine with me.

Where in any way, shape, or form did Verizon "Market" the Eris advertising that 2.1 was coming out? They didn't. The phone works, you may not get all the components that WE have, but your phone works as intended. There was a fix from HTC with small glitches such as the unlock screen, etc., however you weren't "promised" 2.1. There is no documentation whatsoever that proves it.


 

Where in anyway shape, or form, in my post did I say anything about Verizon promising us the 2.1?  Where did I say anything about it being in writing that Verizon advertized the 2.1 coming out? 

Matter of fact, I do believe I said "Forget the promises of navigation and other improvements".

I don't have any idea if the Eris users, when and if ever, are updated to the 2.1, will have all the apps that the Moto Droid has.  That is not even a part of my post.  As a matter of fact, I doubt that they will since they are two seperate manufactures.  It would be like the iPhone having the same apps as the Moto Droid or the HTC Eris.

What my post WAS about, is that the Eris is a faulty phone.  While yes, in the most part, it is a great phone, there are issues with the phone that the 2.1 is suppose to fix.  Or at least they are hoping it will.  And those "promises" have been made by tech support since I have had my phone and called in to complain about the issues that don't work. 

Just to name two of those issues, "voice dialing" and a glitch in Google maps. 

And in case you didn't know, those are not "components" you state, they are part of the phone operation.  Yes they are phone apps, as with any of the others you might chose, but they don't work.  Well, Google maps works 98% of the time.  The other 2% seems to be when I need it the most.  LOL.  Murphy's law.   

The voice dialing, at least on my phone, does not work at all.  

You may get along without phone dialing and Google maps working all the time.  However, when people drive for a living, they can't just pull over when we would like.  And there are times when we have to make phone calls, for many reasons. 

Without voice dialing, you have to use the keypad.  I do believe that DOT would consider that dangerous driving.

You said my phone works as intended.  So voice dialing is not suppose to work on the phones?  Google maps is suppose to "lock up" and tell you that you are on the other side of the world when you are not even close?  The alarm is not suppose to work all the time? 

I am glad that all of those phones are working "as intended".  You say the Eris works as it should.  My I ask, how much you have used an Eris? 

But in closing, I would like to thank you for letting us know that our phones are working like they should.

Two if the issues I am talking about is voice dialing and the glitch in Google maps.

As far as the voice dialing, that should have nothing to do with strength of your signal.  When your phone does not recognize what you are saying or asking it to do, that is the phone. 

As far as the Google glitch, that might be a signal problem, but I have not had that issue.  My "glitches" have usually happened when I had 3 or more bars.  Most times in bigger cities.  Such as Washington DC, Cincinnati, OH, and once right outside of Lexington, KY.

The first time it happened to me, I had to have Verizon reboot the phone completely.  The other times, I turned the phone off when I could, removed the battery, waited a few seconds, put the battery back in and turned the phone on and it "fixed" the glitch.

As far as voice dialing, nothing I have done or that Verizon has told me to do has worked.

See the diction used means everything. "Promising" something means that you are bound to it. Especially as a company. Confirming just means they can aknowledge that it exists, that their intentions will be to deliver it, but if anything comes up they'll let us know.

 

It's all in the wording, guys.


I do believe that where he says "European markets will all be getting upgrades to Android 2.1" is a promise to the European market.  True, he never promised the Amercian market.  You are correct.  If that is true, then Verizon is putting the European market above the American market.  If that is true, why are they marketing so hard in the American market?

These 2.1 crying threads are getting SOO old.  How many do we need?  Do you really think they help?  Did Verizon say they weren't going to release it?  No, some nobody in the local store led you to believe they weren't, probably hoping to sell an Incredible to you.

 

It's real simple at this point.  You have two choices:  Stop acting like you are seven, and be patient.  Or, root your phone and install any custom 2.1 rom you want on the phone.   I chose the second option the day after getting the phone, and have been enjoying 2.1 goodness ever since.

I will cry {word filter avoidance} If i want sence im footing the bill each month after being lied to by the {please keep your posts courteous} verizon sales staff. For right now at least i can and you can say what were feeling. {please keep your posts courteous}

I will be damned if I am going to take this laying down.  Verizon sales reps convinced me that the Eris was a good buy even though it was only running Android 1.5 because HTC would be updating the phones within a couple of weeks to a newer OS version over the air.  Just before my 30 days were up I emailed both companies to ask them if they were still planning to provide an OS update for the Eris and both companies responded soon, so I did not return the phone. 

If both Verizon and HTC fail to deliver anything – they have misrepresented their product.  As far as I am concerned, its false advertisement and I will report both companies to the Federal Trade Commission.   If that does not work then it’s time to start looking at a class action lawsuit.  Verizon and HTC had better get their act together and deliver something or I will see them both in court and don’t think I am kidding either.
