If the smartphone was released before November 18th 2008 then it does not need a data plan. But as you state you may have to ask a few CSR's to get it set up correctly.

That person is referring to the Microsoft Kin One and Kin Two. They sold very poorly as smartphones so Verizon re-released them as the Kin Onem and the Kin Twom.
I have the XV6900 without a data plan and it works quite well for me. I sync it to my computer and outlook for calendar and contacts and use it for text messaging using the handwriting recognition mode.
