I have a family member going through a divorce in Ohio. He is on my cellular family plan. If his estranged wife subpoenas his text records, can they subpoena all the text records from all the phones on the plan, or just from his number? Since the account is not in his name, can they subpoena them at all?
I think that would be up to the judge. It depends on if they can make the case that texts on one or more of the phones are relevant to the case.
